Effective January 1, 2018 New York State enacted New York Paid Family Leave benefits (PFL), which requires employers to provide employees with job protected time off to bond or care for a child, to care for a family member with a serious health condition, to care for a family member undergoing tissue or organ donation, or to help with the needs of a family member impacted by a qualifying military leave.
Starting on January 1, 2021 the new Paid Family Leave (PFL) benefits will be 67% of the employee’s average weekly wage up to a maximum weekly benefit of $971.61. The maximum leave duration will be 12 weeks, not to exceed a total of 26 weeks combined with the NYS Disability benefit.
On September 1, 2020 the Department of Financial Services (DFS) announced that the 2021 premium rate and maximum weekly employee contribution will be .511% of wages per pay period, not to exceed a maximum contribution of $385.34 per year. Below you will find the 2021 benefits and rates compared to 2020. The PFL benefit will be fully phased in come January 2021, offering the maximum 12 week benefit to employees.
